This Terms of Service (ToS) applies only between PT Asanka Hara Nusantara hereinafter referred to as “DJAWAWEB” with customers PT Asanka Hara Nusantara, hereinafter referred to as “Customer”.

Clause 1
Services Activation

Act 1 Completeness of Registration Data
DJAWAWEB required to fill valid data on each form of service provided during registration. The data is loaded in the name MUST be the same as the name of the account holder to use the time of payment. DJAWAWEB reserves the right to not activate if the customer name is different from the name of the owner or the payment account data loaded on the order form proved to be invalid.

Act 2 About Payment Procedures

Act 3 About Service Activation Period
DJAWAWEB akan melakukan aktivasi layanan selambat-lambatnya 3 (tiga) hari setelah menerima pembayaran yang valid dan sesuai dengan ketentuan yang telah disebutkan di Pasal 1 Ayat 1. Khusus untuk layanan website profile dan toko online profesional paket lookup dan custom, layanan akan aktif selambat-lambatnya 1(satu) bulan setelah data yang dibutuhkan (dokumen) diterima dari Customer.

Act 4 About Total & Revision Period

The features are obtained by the Customer in accordance with what is written in the pages Unlimited Hosting package.

Act 2 About Content Permitted in Unlimited Hosting Services
Any content that is available on the server DJAWAWEB must not violate applicable laws and regulations. DJAWAWEB provide rental services and is not responsible for any content contained therein, therefore regardless of any form of lawsuits applicable to personal content Customer if there is evidence of a violation of any kind. The DJAWAWEB enforce broadcasting content is not allowed in Unlimited Hosting, there are:

  • Topsites
  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Software Bajakan/Warez
  • Image Hosting Scripts
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)
  • File Dump/Mirror Scripts/File Sharing
  • Streaming Audio/Video komersial
  • Surat Wasiat/Obligasi
  • High-Yield Interest Programs (HYIP) atau Situs Sejenis
  • Situs Investasi (FOREX, Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Situs Penjualan Zat-zat Terlarang tanpa Ijin dari Pemerintah.

  • PayDay Loan Sites (termasuk didalamnya situs yang berhubungan dengan PayDay loans, PayDay loan affiliate progams, etc)
  • Menyediakan layanan gratis (iklan gratis, email gratis,dll)
  • Menjual barang tiruan/bajakan/palsu atau menjual barang dengan merk palsu.

Act 6 About Content Permitted in Cloud Services Virtual Private Servers
Any content that is available on the server DJAWAWEB must not violate applicable laws and regulations in the State of Indonesia. DJAWAWEB provide rental services and is not responsible for any content contained therein, therefore regardless of any form of lawsuits applicable to personal content Customer if there is evidence of a violation of any kind. The Customer applies the provisions of broadcasting content is not allowed in Cloud Server DJAWAWEB, there are:

  • Using Cloud Servers DJAWAWEB gaming servers such as counterstrike, halflife, battlefield1942, etc.
  • Using Cloud Servers DJAWAWEB as a download server.
  • Using Cloud Servers DJAWAWEB as VPN and tunneling.
  • Using Cloud Servers DJAWAWEB as email bomber / marketing server.
  • Using Cloud Servers DJAWAWEB to send spam emails.
  • Abuse server.
  • Provide illegal content in accordance with the legislation in force.
  • HAKI violations.
  • An insult to individuals/organizations.
  • Selling counterfeit/pirated/counterfeit or selling goods with counterfeit brands.

Act 7 About Abuse Content Services DJAWAWEB

Services Extension

Act 1 On Procedures for Services Extension
Service Fees to be paid by the Customer in accordance with the agreed amount with DJAWAWEB Customer in accordance with the filled registration form at the beginning of the booking service. Payment system refers to Article 1 Paragraph 2 of this service rules. Customer shall make timely payments in accordance with a predetermined date. If within 14 (fourteen) days from the payment due date stated on the bill the Customer has not made the payment, it will be a permanent termination of service without further notice. Currently only DJAWAWEB send bills through email, if the bill is not up or is not readable by the Customer, such as (but not limited to) the Customer‘s mailbox is full, email Customer is no longer active, then DJAWAWEB not responsible and does not eliminate the obligation of Customer to pay the bills.

Act 2 About Termination Services
Cancellation Customer service used in DJAWAWEB is an automated service, DJAWAWEB require a request for cancellation through a Written Application via support ticket in the Member Portal DJAWAWEB area, Slowest 8 Days before the service ended patronize, if not make this request in writing, the Customer will be charged subscribe in full compliance with the hired service and Customer. Clause 4
Back-Up & Restore Data

Act 1 About Terms Of Back-Up Data
DJAWAWEB provide weekly data backup cpanelfree and is as incidental relief. Quota limit back-up provided is 10GB. Customer may request a backup file through ticket requests members. Special user space above 10GB or more than 100,000 inode number for VPS, backup is not provided at all, and backup has been done before will be deleted.

Act 2 About Terms Restore Data
Restore the data only applies to domains registered, the customer who wants to restore addon/subdomain, DJAWAWEB will restore overall fit its main domain.

Uptime Guarantees

Act 1 Uptime Guarantees
DJAWAWEB guarantees 99.9% network and server uptime service unlimited hosting and a 99.9% network and server uptime service Cloud hosting and VPS. Warranty does not apply to a server malfunction, attack, hackers, flooding, server reboots, preventive maintenance and server upgrades.

Act 2 Safety Assurance System
DJAWAWEB provide security on the server system. Including data web files, databases and emails all risks to the security of the data is not caused by the Customer itself. The Customer omission of which is below.

  • Theft access authorization (hosting account and all the facilities in it, Control Panel, email, and billing) as a result of insecurity Customer computer. Customer computer insecurity include the presence of worms, viruses, keyloggers, or because the Customer access from public computers
  • Having a file or directory with all read write permissions (mode 777) on their hosting account

Act 3 Warranty claims for failure
Claims for the failure of the above warranty can be claimed within a maximum of 7 days after disturbance.   • Interference caused by force majeure.
  • Disturbance caused by the disruption caused by the other party.

If interference with server uptime that is claimed by the Customer in accordance with the data belonging to DJAWAWEB, the calculation of the cost of the dilberikan as follows:

  • 2 (two) x costs related services perday x number of days downntime
  • Calculation of 1 (one) during downtime = 0-24 hours of downtime outside SLA guaranteed uptime and downtime reports of appropriate support

Claims will be canceled automatically guarantee failure if:

  • Services are used by Customer otherwise violate the Terms of Service.
  • Services are used by Customer in the temporary suspension or permanent termination imposed.

Service failure claims only apply to the service hosting and VPS. While the services associated with a third party such as domain name registration services and managed services DNS and domain forwarding can not be free in the event of service failure claims. However DJAWAWEB will try my best to convey this matter to the relevant third party.

 

Clause 6
Money Back Guarantee

Act 1 About the Warranty Claim Procedures
DJAWAWEB give money back guarantee for 60 days. The claims procedure is as follows:

  • Customer submit a ticket with the subject “Claims Moneyback Guarantee”.
  • DJAWAWEB will send a letter to the Customer Agreement.
  • Customer approved the letter agreement.
  • DJAWAWEB moneyback guarantee will make 1 (one) to 3 (three) days after receiving the approval letter agreement and discontinue the service.

Act 2 About The Things Cancel Assurance
Money back guarantee does not apply if:

  • Customer did refund the service.
  • Customers who violate the rules of the service.
  • Customer second invoice payment.
  • Customer refund never done before.
  • Should they find that the data entered is invalid.

 

Clause 7
Violations and Penalties

If Customer offense or melnggunakan server exceeds the limits of fair use, it will be subject to termination of service temporarily (suspend), and the customer will get an email with a request to reduce usage. If it still happens the same offense after being warned, then the account will be subject to permanent termination (terminate).

 

Clause 8
Force Majeur

Force majeure is a condition that is beyond the capabilities. For example, natural disasters, floods, storms, expressed by the Government as natural disasters, riots, fires, sabotage, war, epidemics and adherence to the implementation of legislation. Not including force majeure, the things that caused by negligence, negligence, carelessness and / or non-compliance with the implementation of the regulations. Applicable Law

The provision of this service and its implementation is subject to and interpreted in accordance with laws and regulations and the laws of the Republic of Indonesia. In case of any dispute or difference of opinion as a result of the implementation of the provisions of this service, then both the Customer and agreed DJAWAWEB and agreed to finish the deliberation to reach consensus.

 

Clause 10
Adendum

Act 1 Changes in Terms of Service
DJAWAWEB reserves the right to make changes in the rules of the service either in part or in full, without prior notice to Customer.

Act 2 Disclaimer
For any reason, DJAWAWEB not responsible for any losses direct or indirect, incidental or other similar damages for losses due to loss of revenue or profits expected real customer demand and other parties due to disconnection of services DJAWAWEB.

Act 3 Support to institute legal authorities
DJAWAWEB entitled to support law enforcement agencies authorized to provide the necessary information if there is a request based on the law of agency law that authorized without prior notice to Customer. DJAWAWEB fully support the authorized activities of law enforcement agencies.
